Singapore Tuition Agency: Terms And Conditions (For Tutors)


The information in these Terms and Conditions is updated as of 30 May 2007 by CampusTutors. CampusTutors reserves the right to alter the terms and conditions within reasonable limits as situation requires, with or without notice. Continued membership following updates of Terms and Conditions will constitute binding acceptance to changes made.


Tutors, who sign up with CampusTutors, hereby agree to the following Terms and Conditions. By submitting your information, you are deemed to have read the Terms and Conditions, which is legally binding onto you, and any subsequent legal action will be decided based on the Terms and Conditions set forth in this Agreement.


Eligibility
Before you apply for any tuition assignments, please ensure that:

a) You are a Singapore Citizen/Singapore permanent resident or a Valid Employment Pass holder. Student Pass holder is not accepted.

b) You are studying in one of our local Universities namely, Nanyang Technological University (NTU), National University of Singapore (NUS), Singapore Management University (SMU), National Institute of Education (NIE), Singapore University of Technology and Design (SUTD) and Singapore Institute of Management (SIM).

c) You do not have/anticipate a busy schedule and are able to commit fully to the assignment. You bear the full responsibility of ensuring that your existing/future schedule does not affect your commitment before you express your interest to teach. It is advisable to have a few free slots in a week in case your student needs to change the day of lesson. An administrative charge of 50% of the first month tuition fee will be imposed on you in the event that you are unable to commit to the assignment due to a conflict of schedule.

d) The teaching location is convenient for you to go. Take note that you are expected to look up the location in the street directory once you have been given the full address. CampusTutors will not be reliable if the client makes a mistake in providing the full address.

e) You are satisfied with the offered tuition rate. You are not supposed to negotiate the tuition rate with the client or CampusTutors once you have accepted a tuition assignment. In the event that you are terminated by the client due to you negotiating the tuition rate, your account with CampusTutors will be suspended and an administrative charge of 50% of the first month tuition fee will be imposed on you.

f) You are certain that you are experienced in teaching the subject(s) that you wish to apply. An administrative charge of 50% of the first month tuition fee will be imposed on you in the event that the tuition assignment is terminated by the client because you are unsure of the concept of the subject(s) and/or have given the wrong answers to your student. Your student can ask you questions relating to any topics that are within the scope of the syllabus. Please ensure that you are familiar with the current syllabus prior to applying for tuition assignments. It is very common for clients to terminate tuition assignments if the tutors are unable to solve the questions on the spot.

g) You have no biased preference for students from certain races, gender, nationalities and/ or religions.

h) You are able to bring along all your necessary documents to prove your academic qualifications, credentials and NRIC on your first lesson.

Accuracy and Up-To-Date Database
Tutors have to ensure accurate and up-to-date information. Be honest about all information, which you enter in the database. CampusTutors reserves the right to preserve all information entered/ communicated / transmitted through our server online even after tutors have signed out or have been dropped out of our service.

Punctuality
Tutors have to be punctual for all lessons, especially the first lesson. First impression counts. Look up the location of your student's address in the street directory, prior to your first lesson. Client may have given CampusTutors the incorrect address.

In the event that you are late for your lesson, please politely inform your student about it in order to maintain a professional working attitude.

Your student has the right to terminate your service if you have been late for 3 consecutive lessons. Being caught in a heavy rain or a heavy traffic is never a good excuse for being late.

Confidentiality
We do not disclose the contact numbers of the students to our tutors, prior to the first lesson. Tutors are supposed to exchange contact numbers with their students on the first lesson.

Payment of Commission
With every successful assignment, the student will pay us 50% commission after the 2nd week of commencement of tuition, and pay you the remaining 50% after the first one month of tutoring.

You will subsequently be paid the full month's tuition fee directly from the client in your arranged manner. Take note that the client is not reliable for your transportation cost.

Lessons which are postponed during the course of tuition will not affect the commission.
For Example: For a month of 8 lessons, if 1 lesson was cancelled due to any reason (eg. holiday), commission will still be based on 8 lessons and not 7 lessons.

Once the invoice has been sent to the client, and payment has been settled, any dispute over the initially spoken commission charges will not be entertained. Our commission charges will not be affected by the negotiation of tuition fee rate, tuition duration or lesson frequency discussed between you and the client. In any case when you are liable for payment, you must settle it as promptly as possible. Any delay in payment, after 7 days, will result in an extra $2 per week of delay. You account will be suspended. Your school, associated with your email address, will be informed.

CampusTutors possesses the legal rights to these tuition assignments. In the event that CampusTutors fails to collect commission from the client due to payment default, tutor should cease providing tuition service to that client with immediate effect. The next course of action is for both CampusTutors and the tutor to collect any outstanding amount from that client and the amount will be splitted equally between CampusTutors and the tutor. Take note that such dishonest customer is a nuisance to local businesses and that customer will, in turn, cheat or act unreasonably towards the tutor in the future.

* Any attempt to cheat or deprive CampusTutors of our legal share of commission will result in legal actions being taken. This is our administration fee and is therefore non-negotiable.

Relationship of Parties
Registering with CampusTutors as a tutor will not create any partnership, joint venture, franchise, sales representative, or employment relationship between CampusTutors and you. As a tutor, you will have no authority to make or accept any offers or representations on CampusTutors' behalf.

In this case, please be aware that the student/ client is referred to as 'Customer', CampusTutors is referred to as 'Agent' and you are referred to as 'Job Applicant'.

CampusTutors possesses the legal right to select suitable tutors/ candidates for tuition assignments at its own discretion. We are not obliged to answer every enquiry made by tutors via telephone, SMS, email.

Delay of Lesson
a) If the first month of tuition has not been fulfilled, tutor is not allowed to get another person to replace him/her. However, please inform the student if you are unable to make it, and offer a replacement of lesson within the next 7 days.

b) The customer has the right to terminate a tuition assignment with the tutor if the tutor is unable to attend a lesson for two consecutive weeks. Ensure that your school timetable and your daily schedule do not crash with the day and time of the tuition assignment, which you are applying for.

c) If you are sick and unable to turn up for your first lesson, do produce a medical certificate in order to secure a sense of trust between you and your customer. Your first lesson is the lesson on which your customer judges you the most. If you are not seriously ill, you are strongly advised to show up for your first lesson. Most of the time, your long-term relationship with your customer depends on your first impression which you make. CampusTutors only accept official medical certificate or other official proof as an excuse for postponing lesson.

Your customer has the legal right to ask for a medical certificate from you in the event that you are unable to turn up for subsequent lesson due to sickness.

Scope of Lesson
You are supposed to teach your student according to the level and subject as stated in the confirmation SMS. Nothing more and nothing less. An administrative charge of 50% of the first month tuition fee will be imposed on you in the event that the tuition assignment is terminated by the client because you have not taught your student according to the level and subject as stated in the confirmation SMS.

Termination/Cancellation of Assignment
a) In the event where you are unable to attend the tuition, prior notice of more than 24 hours before the lesson time must be given to the student as well as to CampusTutors. This is only applicable for the first month of lessons after which, any dealings would be solely between the student and you.

CampusTutors possesses the legal rights to these tuition assignments. Once a tutor has successfully solicited for an assignment from CampusTutors via telephone and SMS, the tutor will have to bear the full responsibility in the event that a frustration occurs (eg: attending a funeral, falling ill, having a family problem, being hospitalised, working overtime, attending new courses, heavy school workload, etc).

If you fail to give prior notice of more than 24 hours before the lesson time and/ or provide valid document(s) (eg: medical certificate) for your cancellation, your account with CampusTutors will be suspended and an administrative charge of 50% of the first month tuition fee will be imposed on you.

b) The minimum commitment period is 1 month. In the event where you terminate an assignment within the first month, CampusTutors will recover its commission of 50% of the first month tuition fee from you.

c) You bear the full responsibility of ensuring that your personal schedule does not affect the original tuition time during the minimum commitment period of 1 month. In the event that the tuition assignment is terminated by the client during the first 1 month because you are unable to commit to the original tuition time, CampusTutors will recover its commission of 50% of the first month tuition fee from you.

d) If the first month of tuition has not been fulfilled, tutor is not allowed to get another person to replace him/ her.

e) In the event that your tuition assignment is terminated by the student during the first two weeks of lessons, you will not receive any salary. The amount of commission will not be affected by assignment termination or lesson postponement/ cancellation due to any reason.

f) If the customer cancels the assignment before 4 weeks of lessons are completed, and contacts you personally, you are still liable for the original commission of 50% of the tuition fee for a total of 4 weeks. When such situation occurs, you are obligated to let CampusTutors know immediately. Any attempt to keep it from us is considered cheating. The amount of commission will not be affected by assignment termination or lesson postponement/ cancellation due to any reason.

g) In the event that you have been terminated by your client, never argue with your student, your student's parents or CampusTutors. Your client possesses the legal right to terminate your tuition service at any time at his/ her discretion. CampusTutors will not implicate itself in this situation and will not ask for further explanation from the client. In the extreme cases of you arguing with your student, your student's parents or CampusTutors, we will not hesitant to seek assistance from the appropriate authorities. Your school, associated with your email address, will be informed.

Assurance
Tutor bears the responsibility of double-checking with the student on the confirmation of tuition lesson on the day itself. Take note that the client may be absent minded about the time of tuition and it is best to call the student a few hours before travelling down for lesson.

Tutor must create a time-sheet for the student to sign on every lesson in order to have a record of the number of completed tuition hours. In the event that you are shortchanged by the client after CampusTutors has received its legal share of commission, CampusTutors will not act as a debt collector to settle your dispute. Legally, CampusTutors has no way to know whether you are telling the truth since we are not present at the place of tuition.

Tutor's Conduct
Tutor is expected to be a matured adult who is able to teach and also work well with others. Tutor should not have bad habit like being consistently late for lessons, having improper dressing, demonstrating poor commitments, or being inattentive during lesson.

Once you have applied for tuition assignment, you are expected to follow the rules. If you have been identified as a trouble maker, our agency will not hesitate to deal with you fully. Your school, associated with your email address, will be informed. Local tuition agencies constantly share lists of blacklisted tutors among one another.

Do not overstay your tuition time allocated. Your client is not obliged to pay for any extra minutes/hours that have not been arranged beforehand.

Tutor is expected to be polite to our coordinators. We do not tolerate rudeness. Be steadfast in answering coordinators' questions and provide your available time slots accurately during the first call to avoid any unnecessary inconvenience.

After a tutor has verbally agreed to take up a tuition assignment, exchange of SMS confirmation with our coordinator should be prompt and responsive. If our coordinator does not receive prompt replies from the tutor, CampusTutors will move on to engage another tutor who is suitable for that assignment.

We exercise the right to replace a tutor prior to the first lesson at our own discretion.

Disputes
CampusTutors will not entertain disputes between its tutors and coordinators. If you are unable to work well with others, do expect negative responses from us. Local tuition agencies constantly share lists of blacklisted tutors among one another.

CampusTutors will not act as an arbitrator or mediator for any conflicts/ disagreements/ debts that may arise between the tutor and the client. You have applied for a tuition assignment, and just like for any other job assignments in the market, you will naturally encounter customers with different personalities and qualities. CampusTutors makes no guarantee that your relationship with your client will be smooth sailing.

Tutor should never punish or scold the student in any ways. CampusTutors does not approve such unprofessional behaviours and will not hesitant to report the matters to the police and the appropriate authorities. Your school, associated with your email address, will be informed.
